By accessing the TuneBit website at tunebit.app (“Website”) or by downloading, installing, or using the TuneBit software (“Software”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access the Website or use the Software.

These Terms constitute a legally binding agreement between you and Paige Julianne Sullivan (“Author,” “we,” “us,” or “our”).

2. Use of the Software

Your use of the TuneBit software is governed by our End User License Agreement (EULA). These Terms primarily govern your use of the Website and related services. In the event of a conflict between these Terms and the EULA regarding the Software, the EULA shall prevail.

By downloading or using the Software, you acknowledge that you have read, understood, and agreed to the EULA in its entirety.

3. Intellectual Property

All content, features, and functionality on the Website — including but not limited to text, graphics, logos, icons, images, and documentation — are the property of Paige Julianne Sullivan. The TuneBit software is a proprietary, commercial product.

The TuneBit name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Paige Julianne Sullivan. You may not use such marks without prior written permission.

You agree to use the Website only for lawful purposes and in accordance with these Terms. You agree not to:

Use the Website in any way that violates any applicable federal, state, local, or international law or regulation.
Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Website, the server on which the Website is hosted, or any server, computer, or database connected to the Website.
Attempt to circumvent any security features of the Website.

5. Purchases and Subscriptions

a. License

Use of the TuneBit software requires the purchase of a subscription license. All purchases are processed through our third-party reseller, Paddle.com. By purchasing a license, you agree to Paddle's terms of service.

b. Free Trial

We offer a 7-day free trial for the Software. The trial provides full access to all features. At the end of the trial period, you must purchase a license to continue using the Software.

c. Pricing

Current pricing is listed on our Website's pricing page. We reserve the right to change prices at any time. Price changes will not affect existing active subscriptions until the renewal date.

d. Refunds

All refund requests are handled by our reseller, Paddle.com, and are subject to their refund policy.

6. Disclaimer

The Website and all information, content, materials, and services included on or otherwise made available to you through the Website are provided on an “as is” and “as available” basis, without any representations or warranties of any kind, either express or implied.

We do not guarantee that the Website will be available at all times, uninterrupted, or error-free. We do not warrant the accuracy, completeness, or reliability of any content on the Website. We may modify, suspend, or discontinue the Website at any time without notice or liability.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Paige Julianne Sullivan, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with:

Your access to or use of (or inability to access or use) the Website.
Any conduct or content of any third party on the Website.
Any content obtained from the Website.
Unauthorized access, use, or alteration of your transmissions or content.

In no event shall the Company’s total aggregate liability to you for all claims arising out of or relating to these Terms or the Website exceed the greater of (a) the amount you have paid to Paige Julianne Sullivan in the twelve (12) months preceding the claim, or (b) ten dollars ($10.00 USD).

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict-of-law provisions.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Davidson County, North Carolina, and you hereby consent to the personal jurisdiction and venue of such courts.

9. Changes to These Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will update the “Effective Date” at the top of this page. Your continued use of the Website or Software after any such changes constitutes your acceptance of the revised Terms.

It is your responsibility to review these Terms periodically for changes. If you do not agree to the modified Terms, you must stop using the Website and Software.
